By Bill Nolan (April 8, 2019, 12:31 PM EDT) -- In an opinion authored by U.S. Supreme Court Justice Elena Kagan, a 6-3 majority of the Supreme Court affirmed the U.S Court of Appeals for the Sixth Circuit's decision in Biestek v. Berryhill that there should not be a blanket rule that vocational experts at Social Security hearings disclose data underlying their opinions if their opinions are to be credited by the administrative law judge. While the decision seemingly resolved a circuit split on that question, it seems unsatisfying in two respects....
