1-800-Contacts Sues Another Rival Over Pop-Up Ads

Law360, New York (March 19, 2004, 12:00 AM EST) -- Firing another legal volley in its assault on a controversial form of online advertising, contact lens retailer 1-800-Contacts has sued a competitor that bought advertisements designed to pop up when consumers visit its website.

The lawsuit, filed in the U.S. District Court for the District of Utah, accuses rival Coastal Contacts of trademark infringement, unfair competition, trademark dilution, copyright infringement, unfair trade practices and other related claims.

The action follows a judge’s grant of preliminary injunction against another competitor, Vision Direct, over the same technology....
