11th Circ. Revives Builder's Construction Coverage Suit

Law360 (April 11, 2019, 6:10 PM EDT) -- The Eleventh Circuit vacated a federal judge's decision that Southern-Owners Insurance Co. doesn't have to defend a Florida contractor in an underlying suit over construction defects on a custom home, ruling Thursday that the allegations against the contractor could be construed to fall within the policy coverage.

The appeals court vacated a summary judgment ruling against MAC Contractors of Florida LLC, which does business as KJIMS Construction, and said the allegations against the contractor over an unfinished home in Marco Island, Florida, could be construed to allege damages that occurred during ongoing operations, which would be covered under its general liability insurance...
