Travelers Needn't Cover $23M Junk Fax Deal, 11th Circ. Says

Law360 (April 12, 2019, 5:43 PM EDT) -- The Eleventh Circuit on Friday affirmed that a Travelers unit doesn’t have to cover a $23 million settlement in an unsolicited fax class action, saying that the alleged fax blasts don’t meet the definition of an “accident” covered by its policies.

A panel of the appellate court said a Georgia federal judge got it right when she ruled that Travelers subsidiary St. Paul Fire and Marine Insurance Co. doesn't have to pay any part of the whopping deal St. Paul's policyholder, manufacturing quote provider MFG.com, negotiated to end a putative Telephone Consumer Protection Act class action.
