Resort's 'Deceit' Sinks Hurricane Insurance Suit

Law360, New York (August 5, 2009, 4:15 PM EDT) -- A federal magistrate judge has recommended the dismissal of Florida resort owner Bray & Gillespie Management LLC's case against an insurer over hurricane damage, saying discovery misconduct by B&G and its attorneys at Reed Smith LLP calls for dispositive sanctions.

B&G's “callous disregard,” “stubborn defiance” and “deliberate and deceitful conduct” in discovery warrant the dismissal of its case against insurer Lexington Insurance Co., Magistrate Judge Karla R. Spaulding of the U.S. District Court for the Middle District of Florida said in a recommendation issued Monday....
