9th Circ. Gives EPA 90 Days To Respond In Pesticide Case

Law360 (April 19, 2019, 3:54 PM EDT) -- The Ninth Circuit on Friday gave the U.S. Environmental Protection Agency 90 days to respond to objections filed by health and environmental groups over the agency's decision not to ban the pesticide chlorpyrifos.

Groups challenging the EPA's decision praised the deadline as a victory, because if the agency stands by its 2017 decision and rejects their objections, litigation over the finding will be able to proceed in the appeals court.

The groups have argued that chlorpyrifos could decrease children's IQs and cause attention deficit disorders and other issues. The EPA found in a 2016 risk assessment that an analysis of chlorpyrifos...
