Aetna Appeals Trademark Suit After Mutual Fund Wins

Law360, New York (October 10, 2006, 12:00 AM EDT) -- Health care insurance company Aetna Inc. has appealed a trademark infringement lawsuit won by a $16.6 billion mutual fund, after a district court ruled the name of a new Aetna unit violates the fund’s mark.

The appeal, filed with the U.S. Court of Appeals for the Eighth Circuit in St. Paul, Minn., was filed less than one month after mutual fund Advantus Capital Management Inc. prevailed in its effort to stop Aetna from naming a new business Advantus.
