Organon Loses Bid To Nix NuvaRing Complaint

Law360, New York (August 6, 2009, 7:36 PM EDT) -- The federal judge overseeing the multidistrict litigation regarding Schering-Plough Corp. unit Organon International Inc.'s NuvaRing contraceptive has rejected the company's request to have the master consolidated complaint in the case tossed.

Judge Rodney W. Sippel of the U.S. District Court for the Eastern District of Missouri ruled Thursday that because Organon had already filed answers to the 150 individual complaints in the case, the company was procedurally barred from moving to dismiss the consolidated complaint on the ground that it lacked specificity.
