Zyprexa Failure-To-Warn Suit Survives In MDL

Law360, New York (August 7, 2009, 2:57 PM EDT) -- A federal judge has refused to throw out a woman's claims that Eli Lilly & Co.'s anti-psychotic Zyprexa caused her to develop diabetes, finding that a material issue of fact remains as to whether the company's alleged failure to warn of the drug's risks caused or worsened the condition.
