Air Tests For FEMA Trailer Are Valid: Court

Law360, New York (August 7, 2009, 4:10 PM EDT) -- Fleetwood Enterprises Inc. has lost a bid to exclude trailer tests from one of the bellwether cases in multidistrict litigation over formaldehyde levels in emergency housing, potentially bolstering allegations the U.S. government and manufacturers provided toxic trailers to hurricane victims.

Judge Kurt D. Engelhardt of the U.S. District Court for the Eastern District of Louisiana ruled Thursday that plaintiff Elisha Dubuclet is allowed to present the test results evidencing elevated formaldehyde levels in the trailer she occupied after hurricanes Katrina and Rita in 2005.
