FTD Seeks Declaratory Judgment On NCR Business Method Patents

Law360, New York (March 19, 2004, 12:00 AM EST) -- In a suit involving five disputed “business method” patents, Florists' Transworld Delivery (FTD) has asked a judge to declare that its websites do not infringe five e-commerce patents held by automated-teller machine and data warehouse-software concern NCR Corp.

The flower delivery service also asked the U.S. District Court in Delaware to declare the NCR patents invalid.

In its complaint, FTD said it "has a reasonable apprehension that NCR will bring suit against FTD for infringement" as attempts to negotiate a settlement have failed.
