UPS Discriminated Against Deaf Drivers, Court Rules

Law360, New York (October 11, 2006, 12:00 AM EDT) -- A U.S. appeals court panel has upheld a lower court ruling that UPS Inc. violated the Americans with Disabilities Act by excluding the deaf from truck driver positions.

In Thursday’s opinion, the U.S. Court of Appeals for the Ninth Circuit agreed that all candidates must be judged individually, and that a person’s lack of hearing does not necessarily make him or her more dangerous on the road.
