Indian Company Sued Over Clarinex ANDA

Law360, New York (October 11, 2006, 12:00 AM EDT) -- A Cephalon Inc. subsidiary has joined the heated legal battle over the market for anti-allergy drug Clarinex, accusing an Indian company of patent infringement stemming from an Abbreviated New Drug Application.

Cima Labs Inc. filed suit against Orchid Chemicals & Pharmaceuticals Ltd. in federal court in New Jersey on Tuesday. Orchid was one of 20 defendants pharmaceutical powerhouse Schering Corp. targeted last month in another patent infringement lawsuit meant to stave off generic competition for Clarinex.
