No Prejudgment Interest In Goodyear Suit: 10th Circ.

Law360, New York (August 12, 2009, 1:43 PM EDT) -- A federal appeals court has affirmed a decision not to award prejudgment interest after a jury ordered Goodyear Tire & Rubber Co. to fork over $2.2 million in damages for producing defective hosing used in heating systems.

In a ruling Tuesday a three-judge panel of the U.S. Court of Appeals for the Tenth Circuit said the nature of plaintiff AE Inc.’s proffered evidence did not allow the jury to calculate damages in a manner permitting an award of prejudgment interest under Utah law.
