Judge Refuses To Vacate Bush-Era Mining Rule

Law360, New York (August 12, 2009, 7:34 PM EDT) -- A federal judge has refused to vacate a Bush-era rule that relaxed environmental standards for mountaintop removal coal mining, finding that vacating the policy would improperly bypass established statutory procedures for repealing an agency rule.

The ruling, handed down Wednesday in the U.S. District Court for the District of Columbia, came as a blow to both Secretary of the Interior Ken Salazar and green groups, which have fought to reverse the rule.
