'Two Buck Chuck' Maker Hit With Trademark Suit

Law360, New York (August 13, 2009, 7:41 PM EDT) -- Casella Wines Pty Ltd., the Australian maker of Yellow Tail wine, has sued Bronco Wine Co. for allegedly infringing the “[yellow tail]” trademark and engaging in unfair competition with the introduction of its new “[Down Under]” Australian wine with a similar label.

In a complaint filed Wednesday in the U.S. District Court for the Southern District of New York, Casella alleged that Bronco, along with its subsidiary Barrel Ten Quarter Circle Inc., infringed the “[yellow tail]” trademark by launching “[Down Under]” wine earlier this year....
