The Illinois Fair Tax Amendment Is Narrow And Limited

By Paul Berks (June 6, 2019, 3:20 PM EDT) -- By passing Senate Joint Resolution Constitutional Amendment No. 1, or SJRCA 1, the Illinois General Assembly took a critical step toward allowing voters to decide whether to amend the Illinois Constitution to permit graduated income tax rates. As Michael Wynne recognizes in "Illinois Tax Talk: Scope of the Graduated Rate Amendment," the Illinois Constitution currently prohibits the state from imposing higher tax rates on higher income levels, and the proposed amendment set forth in SJRCA 1 will eliminate that bar. I consulted with the office of Illinois Gov. J.B. Pritzker during the drafting of this resolution to amend the state constitution....
