9th Circ. Sides With EPA In Goodrich CERCLA Spat

Law360, New York (August 17, 2009, 3:59 PM EDT) -- A federal appeals court has upheld the dismissal of Goodrich Corp.'s suit challenging a U.S. Environmental Protection Agency unilateral administrative order over a California site the company allegedly contaminated, citing lack of jurisdiction.

The U.S. Court of Appeals for the Ninth Circuit sided with prior district court rulings in a decision passed down Thursday, asserting that the district court lacks jurisdiction to review pattern and practice claims brought under the Comprehensive Environmental Response Compensation and Liability Act.
