Judge Mulling Far-Reaching Discovery In Plan B Case

Law360, New York (October 12, 2006, 12:00 AM EDT) -- A judge has said he is considering allowing discovery that could end up reaching into the White House in a lawsuit over the U.S. Food and Drug Administration's handling of the morning-after pill.

Magistrate Judge Viktor Pohorelsky said Wednesday that he is inclined to allow discovery in a lawsuit alleging that the FDA's long denial to allow Plan B to be sold over-the-counter was arbitrary and capricious.
