Bray Creditors Seek To Preserve Lexington Suit

Law360, New York (August 18, 2009, 6:50 PM EDT) -- Creditors of real estate developer Bray & Gillespie Management LLC are asking a federal judge not to dismiss its case against Lexington Insurance Co. over coverage for hurricane damage, saying it would unfairly deny them access to more than $25 million in claims.

Creditor agent Soneet R. Kapila and Ocean Waters Asset Co. LLC filed documents Monday in the U.S. District Court for the Middle District of Florida objecting to a magistrate judge's recommendation earlier this month to dismiss the case because of B&G's alleged discovery...
