Fen-Phen Atty Holds On To $5.7M Arbitration Award

Law360, New York (August 18, 2009, 4:33 PM EDT) -- A federal judge has confirmed a $5.7 million arbitration award in favor of a plaintiffs lawyer who was allegedly shortchanged by another plaintiffs lawyer while they were litigating product liability cases involving the diet drug fen-phen.

Judge Dee Benson of the U.S. District Court for the District of Utah ruled Thursday that Charles Abbott could not prove fraud or willful misconduct by the arbitrators, and that the award must therefore stand in favor of Patrick Mulligan.
