Costco Settlement In Hot Fuel MDL Gets First OK

Law360, New York (August 18, 2009, 5:43 PM EDT) -- A federal judge has preliminarily approved a settlement class regarding defendant Costco Wholesale Corp. in the multidistrict case pitting consumers in more than 20 states against companies accused of deceptive retail practices when selling motor fuel at a specified price per gallon without adjusting for temperature.

Thursday's order, issued by Judge Kathryn H. Vratil in the U.S. District Court for the District of Kansas, overruled a motion to delay the approval of the Costco deal until briefing on class certification issues for nonsettling defendants is completed,...
