Gov't Misconduct Means New Trial For Brocade CEO

Law360, New York (August 18, 2009, 6:24 PM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has reversed the conviction of Brocade Communications Systems Inc.'s former CEO, who earlier was sentenced to spend 21 months in prison and fork over a $15 million fine for allegedly engineering a massive backdating scheme at the data storage company.

The appeals court on Tuesday threw out Gregory Reyes' conviction and ordered a new trial for the former executive while upholding the conviction of Stephanie Jensen, vice president of Brocade's human resources department.
