7th Circ. Upholds DOL's New Immigrant Work Rules

Law360, New York (August 20, 2009, 12:31 PM EDT) -- An appeals court has ruled that the U.S. Department of Labor has the power to impose a 180-day deadline for certified potential immigrants to apply for visas, dismissing an appeal launched by 14 companies that challenged the new regulation.

A three-judge panel in the U.S. Court of Appeals for the Seventh Circuit found that the revision fell within the scope of the DOL's authority since it is the agency's duty to determine the “sufficiency” of prospective workers when they apply for visas.
