Facebook Says Suit Over Fake 'Likes' Must Remain In Calif.

Law360 (July 12, 2019, 8:02 PM EDT) -- Facebook and Instagram are fighting New Zealand-based Social Media Series Ltd.'s bid to dismiss a $10 million suit the social media giants lodged against it for allegedly selling fake “likes,” saying SMS consented to the jurisdiction of California courts and therefore the case doesn’t belong in New Zealand.

In their opposition to a motion to dismiss filed Wednesday, Facebook Inc. and Instagram LLC said SMS’ argument that it never agreed to Instagram’s terms of use cannot be grounds to undo California’s jurisdiction over the suit.
