Coverage Spat Over Drilling Co.'s Waste Nixed

Law360, New York (August 21, 2009, 5:45 PM EDT) -- A federal judge has dismissed Mid-Continent Casualty Co.'s bid for a declaration that it does not have to indemnify its insured Harvest Petroleum Inc. in an underlying suit filed by a landowner accusing the energy company of polluting his property.

Judge Reed C. O'Connor of the U.S. District Court for the Northern District of Texas dropped the 2-year-old suit without prejudice Aug. 20, saying the dispute was not yet ripe because it is unclear whether Harvest will be held liable in the state property damage suit....
