Court Rules Mylan Infringes J&J Duragesic Patent

Law360 (March 26, 2004, 12:00 AM EST) -- A federal court in Vermont ruled Mylan Laboratories Inc.'s generic version of Johnson & Johnson’s Duragesic pain-relief patch infringed a patent held by Johnson & Johnson.

Mylan said it plans to appeal the decision and bring its generic version to market this summer, but J&J said it believes it should retain U.S. exclusivity over Duragesic until January 2005.

"Although we are disappointed with the court's ruling," Mylan vice chairman and chief executive Robert Coury said, "we intend to file an appeal."
