Russian Metals Co. Sues DOC Over Magnesium Duty

Law360, New York (August 25, 2009, 8:09 PM EDT) -- Russian metals giant PSC VSMPO-AVISMA Corp. has launched a suit against the U.S. Department of Commerce over a magnesium anti-dumping duty rate, which AVISMA claims is too high.

AVISMA filed a complaint against the U.S. government Aug. 19 in the U.S. Court of International Trade, after the DOC stuck with a 43.58 percent ad valorem duty rate it had preliminary imposed on AVISMA's magnesium. AVISMA claims that rate is punitive and improperly calculated.
