Bemis Retiree Benefits Class Action Gets The Boot

Law360, New York (August 28, 2009, 12:42 PM EDT) -- A federal judge has thrown out a class action accusing packaging company Bemis Co. Inc. of breaching a plant-closing deal by reducing health benefits, ruling that the agreement did not explicitly promise specific levels of health coverage.

Three months after granting class certification in the suit, Judge J.P. Stadtmueller of the U.S. District Court for the Eastern District of Wisconsin on Wednesday found that the plant-closing agreement in question did not explicitly promise continued full prescription drug benefits and low deductibles for retirees.
