Monsanto Says LA County's PCB Suit Filed Too Late

Law360 (September 3, 2019, 8:14 PM EDT) -- Bayer AG's Monsanto Co. and other companies said Friday they should not have to face Los Angeles County's bid to recoup costs from the cleanup of polychlorinated biphenyls, arguing that since the substance hasn't been manufactured since the 1970s, the allegations were too old.

Pharmacia LLC, known as "Old Monsanto," made PCBs up until the 1970s for use by the electrical industry and others  — hardly recent enough for LA County to overcome the three-year time bar that constrains its allegations, according to the motion to dismiss.
