9th Circ. Sinks Toolmaker's Appeal Of Antitrust Suit

Law360, New York (August 31, 2009, 2:00 PM EDT) -- A federal appeals court has affirmed the dismissal of toolmaker Destiny Tool's $2 million lawsuit accusing rivals SGS Tools Co. and Dauphin Precision Tool LLC of antitrust violations, which stemmed from a patent infringement suit brought by SGS and Dauphin against Destiny.

Friday's decision by the U.S. Court of Appeals for the Ninth Circuit could mark the end of the line for litigation between the toolmakers, which have gone after each other hammer and tong in Ohio and California courts.
