Apache Contract Claim Over Missing Gas Struck Down

Law360, New York (September 1, 2009, 1:42 PM EDT) -- The Supreme Court of Texas has thrown out a $1.5 million judgment in favor of oil and gas production and exploration company Apache Corp. in a contract dispute, ruling that Apache is not entitled to damages for gas that disappeared between Apache's wellheads and various processing plants.

The state high court handed down its opinion on Aug. 28, affirming and reversing in part an appeals court's decision to reinstate Apache's contract claim and enter a judgment of $1,508,674 in Apache's favor.
