Tyco Ordered To Pay $135M In Patent Suit

Law360, New York (March 29, 2004, 12:00 AM EST) -- A federal jury in Los Angeles has awarded $134.5 million in damages to medical device maker Masimo after finding that a unit of Tyco International willfully infringed four patents held by the company.

Judge Mariana R. Pfaelzer of the U.S. District Court for the Central District of California could award triple damages based on willful infringement.

The penalty award followed a jury verdict that found Tyco unit Nellcor had willfully infringed four of Masimo's patents on its read-through-motion pulse oximetry technology -- devices used to measure...
