NRDC Loses Challenge To Calif. Water Contracts

Law360, New York (September 2, 2009, 6:03 PM EDT) -- A coalition of environmental groups including the Natural Resources Defense Council has lost an effort to challenge several long-term water supply contracts in California under the Endangered Species Act.

Judge Oliver W. Wanger of the U.S. District Court for the Eastern District of California on Tuesday denied the plaintiffs' motion for summary judgment, ruling they did not have standing to challenge one set of contracts and that the government was restrained in its ability to modify another set.
