US' Asbestos Evidence Barred In San Diego Gas Case

Law360, New York (September 2, 2009, 7:06 PM EDT) -- A federal judge has barred prosecutors from submitting any of the 27 samples of asbestos-containing material they proposed to use to support a criminal Clean Air Act case against San Diego Gas & Electric Co.

Judge Dana M. Sabraw of the U.S. District Court for the Southern District of California ruled Monday that the government's samples were either not representative of the material at issue in the case or were improperly tested, or both.
