Union On Hook For Pittsburgh Mack Pensions: 3rd Circ.

Law360, New York (September 8, 2009, 4:38 PM EDT) -- A federal appeals court has concluded that a union’s agreement to indemnify Pittsburgh Mack Sales & Service Inc. for withdrawal liability to a pension plan is enforceable, vacating a lower court's decision that the pact violates public policy.

The U.S. Court of Appeals for the Third Circuit on Friday said it discerned no “well-defined and dominant” public policy that would justify invalidating the two collective bargaining agreements between Pittsburgh Mack and the union, and determined that a district court erred in tossing the company’s declaratory judgment...
