BIS Clamps Down On In-Country Transfers

Law360, New York (September 9, 2009, 12:36 PM EDT) -- The Bureau of Industry and Security has published a final rule amending sections of the Export Administration Regulations, specifying that certain in-country transfers of sensitive items are now subject to licensing requirements.

In amended rules published in the Federal Register on Tuesday, the BIS said in-country transfers of items subject to the EAR to parties on the agency's Entity List would now be subject to the Entity List's licensing requirements.

Previously, the EAR specified license requirements for exports and re-exports to those on the Entity List....
