Freeport-McMoRan Lead Suit Heads Back To Okla.

Law360, New York (September 9, 2009, 6:08 PM EDT) -- A federal appeals court has ruled that a putative class action brought by residents of an Oklahoma town against Freeport-McMoRan Copper & Gold Inc. and other metal companies over pollution stemming from a smelter plant should remain in state court.

The U.S. Court of Appeals for the Tenth Circuit ruled Friday that the lower court was right in sending the case back to a state venue, saying that it fell within the “local controversy exception” of the Class Action Fairness Act.
