Most Claims Nixed In Virgin Islands Scrap Metal Suit

Law360, New York (September 11, 2009, 4:20 PM EDT) -- A federal judge in the U.S. Virgin Islands has thrown out most claims made by Florida-based Bennington Foods LLC in its multimillion-dollar breach of contract lawsuit against the owner of property where a major scrap metal cleanup was to take place.

Bennington's demands for specific performance under the contract and its claims of fraud, tortious interference and spoliation against defendant St. Croix Renaissance Group LLP all were thrown out Sept. 8 in the U.S. District Court for the District of the Virgin Islands.
