US Fights To Quash Broker's Suit Over Bag Duties

Law360, New York (September 11, 2009, 6:03 PM EDT) -- The U.S. government has asked the U.S. Court of International Trade to dismiss a Puerto Rican customs broker's suit over anti-dumping duties imposed on plastic shopping bags imported from Thailand, contending the court lacks jurisdiction.

On Tuesday, the federal government filed its motion to dismiss San Juan-based G. Padilla & Co.'s suit protesting the $92,177 in dumping duties.

The U.S. Department of Commerce determined in June 2004 that polyethylene retail carrier bags were being dumped from Thailand at rates between 0.62 percent and 122.88 percent, according...
