Medical Pot Vapers Ask Mass. High Court To Let Ban Lapse

Law360 (November 8, 2019, 8:01 PM EST) -- Massachusetts medical marijuana patients on Friday asked the state’s high court not to stay a lower court judge’s order that places the fate of the governor’s ban on medical marijuana vapes in the hands of the state’s cannabis regulator.

The patients said Suffolk County Superior Court Judge Douglas Wilkins was correct in his analysis, rendered in an order Tuesday, that legislation legalizing marijuana in the commonwealth expressly transferred regulation of medical cannabis to the state's Cannabis Control Commission.
