Insurer Has Duty To Defend In Cleanup Spat: Judge

Law360, New York (September 16, 2009, 4:48 PM EDT) -- American Nuclear Insurers has a duty to defend two companies against a U.S. Environmental Protection Agency order to clean up pollution at a metal manufacturing facility they owned that used radioactive materials.

But Judge Richard G. Stearns of the U.S. District Court for the District of Massachusetts said Sept. 15 that it still is an open question whether the insurance company is responsible for reimbursing Whittaker Corp. and Textron Inc. for cleanup costs related to the government order. He referred that to trial.
