Coke Loses Bid To Dismiss Pom's Fruit Juice Suit

Law360, New York (September 16, 2009, 1:09 PM EDT) -- A federal judge has denied Coca-Cola Co.'s request to toss Lanham Act and state law claims lodged by Pom Wonderful Inc. in a suit accusing Coke of falsely advertising the ingredients in its pomegranate-blend juice.

Judge S. James Otero of the U.S. District Court for the Central District of California ruled Tuesday that Pom is permitted to continue discovery in furtherance of its Lanham Act claims against Coca-Cola even though a previous ruling had dismissed some of these allegations.
