RICO, FLSA Claims Survive In Hospital Workers' Suit

Law360, New York (September 18, 2009, 6:54 PM EDT) -- A federal judge has upheld the Racketeer Influenced and Corrupt Organizations Act and Fair Labor Standards Act claims of a group of employees who sued a Pittsburgh-area hospital system over its meal break pay practices.

Magistrate Judge Cathy Bissoon of the U.S. District Court for the Western District of Pennsylvania handed down an order Thursday denying Pittsburgh Mercy Health System Inc.'s motion to dismiss the plaintiffs' RICO and FLSA claims but removed separate allegations of estoppel.
