Black Box Hits Avaya With Revised Antitrust Claims

Law360, New York (September 21, 2009, 2:28 PM EDT) -- Telecommunications systems service and maintenance company Black Box Corp. has made new antitrust allegations against Avaya Inc., a move that comes a month after a federal judge dismissed Black Box's initial illegal tying and monopolization claims.

In a second amended complaint filed in the U.S. District Court for the District of New Jersey on Sept. 18, Black Box tweaked its claims under the Sherman Act and asserted new state law violations of breach of covenant of good faith and fair dealing.
