Responding To Federal Criminal Trial Subpoenas

Law360, New York (September 25, 2009, 11:22 AM EDT) -- Almost any business can be drawn into a federal criminal proceeding by receipt of a trial subpoena for records served by the defense or the prosecution pursuant to Federal Rule of Criminal Procedure 17(c).

The company need not have done anything wrong, of course. It may be the victim of the crime charged, or the employer of a defendant, or a customer, vendor or supplier of another business charged with an offense.
