DOJ Hiring Plaintiffs Lose Round In Class Cert. Fight

Law360, New York (September 23, 2009, 7:32 PM EDT) -- A group of plaintiffs who claimed the U.S. Department of Justice refused to hire them because of their liberal political leanings had their bid for class certification denied without prejudice, following a recent ruling that cut down their case.

Judge John D. Bates of the U.S. District Court for the District of Columbia signed an order on Wednesday rejecting the bid for class certification because the factual basis underlying the motion had changed, and giving the plaintiffs until Oct. 23 to file a new class certification...
