6th Circ. Tosses Insurer's Marina Coverage Suit

Law360, New York (September 25, 2009, 3:57 PM EDT) -- A federal appeals court has upheld the dismissal of New Hampshire Insurance Co.'s suit seeking to avoid having to defend and indemnify policyholder National Marine Inc., a marina company found liable in an Ohio court of selling boats without clean title.

However, according to Thursday's ruling in the U.S. Court of Appeals for the Sixth Circuit, the district court was wrong to assume federal jurisdiction existed under maritime law simply because the policy was granted to a marina operator.
