Clarendon Contract Claim Survives Bid To Dismiss

Law360, New York (September 25, 2009, 6:09 PM EDT) -- A federal judge has refused to dismiss Clarendon National Insurance Co.'s breach of contract claim against Health Plan Administrators in a suit accusing the claims administrator of sparking an expensive battle between the insurer and its policyholders by rescinding policies.

Judge George B. Daniels of the U.S. District Court for the Southern District of New York on Thursday denied HPA's motion to dismiss breach of contract, indemnification and guarantor claims, as well as its motion for summary judgment.
