Proprietary Info Claim Nixed In New Balance IP Suit

Law360, New York (September 25, 2009, 3:45 PM EDT) -- A federal judge has tossed part of a lawsuit alleging New Balance Athletic Shoe Inc. stole Hockerson-Halberstadt LLC’s patented design for a shoe insert during confidential business meetings.

Judge Jay C. Zainey of the U.S. District Court for the Eastern District of Louisiana granted Lousiana-based Hockerson and co-plaintiff Standon LLC’s motion to dismiss the misappropriation of proprietary information claim from the patent infringement lawsuit Thursday.
